Seekee Privacy Policy

Seekee Verge Co., Ltd. (‘Seekee’) offers a variety of measures to protect your privacy when you use Seekee Services, including Seekee and other related services linked to this Privacy Policy. We have created this Privacy Policy to explain our privacy practices so you will understand what information is collected, how it is used, and your rights to your information. Any references in this Privacy Policy to "Seekee", "we", "our", "us" etc. will be interpreted as a reference to Seekee.

We collect personal information in the following ways:

2.1 Personal Information You Provide Us

Account Information: When you create an account, including when you log in to our services with a Google account, you are authorizing us to collect your personal information, which may include your username, email address, avatar and account credentials. You don't need to sign in to use most of our services and it’s your choice whether to create a Seekee account.

Communication Information: When you provide feedback, chat with an agent, contact us via email, participate in surveys, or message us on social media, we may collect the input content you provide to Seekee Services, such as your prompts, audio and contact information, depending on the functionality you use.

Customer Support Information: When you contact us with inquiries, complaints, problem reports or requests to exercise your rights, we process your contact details, the content of your request, the attachments you provide and the corresponding communication and handling records.

Uploaded Images: When you use our AI image features, we collect and process the images you choose to upload, including images that may contain people. Seekee does not collect, extract, or store any biometric face data, including facial templates, facial landmarks, facial embeddings, or any other biometric identifiers. The specific restrictions in Sections 5, 6 and 7 apply to these images.

Search Input: You may enter search terms yourself. For the scope of processing involved in search and web browsing and related precautions, see “Search and Web Browsing Information” in Section 2.2.

Files You Select or Provide: When you select, import or submit files for a feature, we process the file content needed to complete the action you choose. For the full scope of processing for downloads and file management, file sharing, AI or cloud processing and file access permission boundaries, see “Downloads and File Management” in Section 2.2.

Transaction Information You Provide: You may provide transaction-related information to us when using paid services. The full scope and purposes of processing transaction information are described under “Transaction Information” in Section 2.2 and are not limited to information you actively provide.

Other Information You Provide Us: We also collect other information that you choose to share with us. When you use Seekee Services, Seekee will have access to information you post to Seekee including, but not limited to, threads and comments you post in forums.

2.2 Personal Information Generated During Use or Collected Automatically

While you use our services, information may be generated or collected automatically, including but not limited to the following:

Device Information: such as your device model, release date, brand, operating system version, hardware specifications, language preferences, time and time zone, errors and diagnostic reports, and other hardware specification information about the model and manufacturer of your device.

Usage Information: such as information about how you use our apps, what features you browse, how you search, how you interact with our products, any crashes you experience, performance data, and other diagnostic data.

Network Information: such as IP address, mobile network operator, and network status (e.g., 3G or Wi-Fi).

Location (if you grant permission): When you visit some location-based sites, we may collect your location information after your authorization.

Cookies and Tracking Technology: When you are visiting internet sites through Seekee, we may use cookies (and similar technologies) to gather information regarding the date and time of your visit and what you search and view. Cookies are computer files that are saved to your device and which may store information about you, your device, and your browser and that may be used to transmit that information to us. For example, cookies are used to identify your device and record the visit so that the Seekee Services can allow your access to your account without requiring you to re-enter certain information.

Device, Operational and Security Information: To maintain service operations, troubleshoot issues and protect account and system security, we process the app version, operating system version, device category, language, network status, IP address, error codes, performance records, crash information and necessary security identifiers relevant to these purposes.

The processing of diagnostic and security data should be limited to what is necessary for the relevant purposes. If we need you to provide content or attachments to troubleshoot an issue, we will explain what information is needed and take appropriate measures to protect any personal information it contains.

Search and Web Browsing Information: When you use search, search suggestions, web access or link navigation features, the relevant services need to process search terms, requested URLs, request times, IP addresses, necessary device or browser request information, and the cookies and other site data needed to complete the requests.

The websites you visit and the providers of their content, images, videos or other resources may directly receive the information needed to complete network requests. If search or web requests pass through our services, we process the request information needed to provide the relevant functionality.

URLs, search terms and web content may contain personal information. Please do not submit passwords, verification codes or sensitive information unrelated to the purpose of use in the search box or in unnecessary requests.

Tabs, Bookmarks, History and Preferences: Multiple-tab, bookmark and history features need to process page titles, URLs, visit times, tab states, bookmark records and related settings to save or restore browsing states, find previously visited content and carry out your instructions. Playback history may also involve media sources, playback progress and playback settings.

Clearing records on your device, turning off synchronization and deleting server-side copies may have different effects.

Video Playback and Video Takeover: When you use video takeover or enhanced playback features, we process the original web page URL, video resource URL, necessary network request information, media title, cover image, subtitles, audio tracks, video quality, playback progress and playback error information needed to identify, load, play and control the video.

If web pages, subtitles or media content are further used for AI services, the relevant provisions of this Policy apply; where uploaded images are involved, the specific restrictions in Sections 5, 6 and 7 also apply.

Reading, Translation, Image Viewing and Page Adjustments: Reading mode, image-viewing mode, ad blocking and web page element removal features need to process the relevant page structure, text, image URLs, resource requests, blocking rules and the page elements or site preferences you select to adjust how the page is displayed or carry out your requested actions.

Web page translation needs to process the selected text or web content, the source language and the target language. When a cloud translation service is used, the content to be translated is sent to the relevant service provider. Pages accessed while signed in may contain private communications, orders or other personal information. Please pay attention to the scope of the selected content before using this feature.

Removing web page elements or blocking resource requests does not delete information already collected by third parties and does not guarantee that all tracking activities will be prevented.

Downloads and File Management: When you download, import, preview, rename, move, export, share or delete files, the relevant features need to process the file source, name, type, size, storage location, download status and the file content needed to complete the selected action.

When you share a file with another app or service, the recipient you choose will receive the file and accompanying information. When you submit files to AI or other cloud features, the relevant content is processed in accordance with this Policy. Selecting a specific file or image does not authorize access to all files or images on your device.

Transaction Information: If you use paid services, we process the product information, transaction identifiers, purchase status and transaction records needed to verify transactions, provide entitlements, process refunds and fulfill related obligations. Payment service providers process payment information according to their own responsibilities. The information they actually receive and their processing practices are subject to the relevant notices.

2.3 Personal Information We Obtain from Third Parties

Third-Party Login and Other Sources: We may obtain information about you from business partners, contractors, and other third parties and combine it with information we have collected directly from you. For example, you may log in to our services through Google. We may have access to your Google profile information, such as your email address and avatar (for details, please refer to the authorization page provided by that third party).

Information from Payment Service Providers: If we obtain transaction-related information from a payment service provider, the data categories, processing purposes and relevant information about payment service providers are described under “Transaction Information” in Section 2.2.

Seekee may integrate third party technology or code, such as SDKs. Some of them may collect or process your information in various ways. Except for processing carried out on our behalf as described in Section 6, this Privacy Policy does not apply to the independent information practices of these third parties, and Seekee shall not be responsible for those independent information practices. These exclusions do not limit the restrictions on uploaded images or the commitments regarding AI service providers in this Privacy Policy.

AppsFlyer SDK

Certain websites may require your information when you are browsing. For example when you visit an online map or search engine, it may request access to your location information. When you are trying to upload an attachment to your mailbox, it may request access to the files on your device. You may receive pop up messages on your device that indicate that the “Seekee requests your permission,” but these messages are sent by the website you visited directly and that information is not received by Seekee. This section concerns information provided directly to independent websites, not images you upload to Seekee for its AI features.

It will be up to you to decide to give such permission to these websites. Yet please understand that if you deny such permissions, certain functions may be disabled. For example, if you do not allow access to your location information, the online map will not know where you are and the search engine will not be able to provide location-based search results; if you do not allow your files to be read, you may not upload attachments to your mailbox. You can always manage the permissions via your phone settings.

We use the information we collect for the following purposes, subject to the specific restrictions on uploaded images set out below. These general purposes do not authorize any broader use of uploaded images:

a) to provide, analyze, and maintain our Services, and process and complete transactions. Such Services include browser service, search service, Seekee account, AI chat, Seekee drive. These services we provide may change from time to time.

b) to make our Services better and do research, like developing new product features.

c) to defend against malicious websites and prevent fraud.

d) to measure and improve those services and features.

e) to provide you with customer and technical support.

f) for statistical purposes and for reporting to allow us, for example, to monitor performance and detect technical problems.

g) to release aggregated non-personal information such as usage trends.

h) to contact you with any service-related announcements from time to time.

i) to ensure that content from the Seekee Services is presented in the most effective manner for you and for your device.

j) to provide marketing information and surveys to you in relation to the Seekee Services where you have given your consent, or we are otherwise legally entitled.

k) to comply with any legal obligation that we have, including obligations relating to legal proceedings, or to establish, exercise or defend our legal rights.

l) to follow the law and protect the rights, safety, privacy and property of our users, Seekee, and other parties.

m) Where we have relied on consent to process your information, you may withdraw your consent at any time by contacting us using the contact details below. Withdrawing consent does not affect the lawfulness of processing based on consent before it is withdrawn.

With respect to images you upload, we use them solely to perform the AI features you request, such as AI image generation and AI image editing. We do not perform facial recognition, identity verification, authentication, profiling, or any form of biometric analysis on uploaded images. Uploaded images are never used to train facial recognition models.

We do not sell, trade, or rent your personal information to third parties. We may share your information only in the following circumstances:

- With your consent - To comply with legal obligations - To protect our rights and prevent fraud - With service providers who assist in our operations. This includes AI service providers that process uploaded images on our behalf.

Service providers may support search, technical and operational support, cloud hosting, automatic speech recognition, data analysis, site functionality and customer support. They are not permitted to share or use the information for any purpose other than providing services to us. The stricter restrictions below apply to uploaded images processed by AI service providers.

When you use our AI features, the images you upload may be securely transmitted to AI service providers solely for the purpose of fulfilling your requested operation. These AI service providers are contractually prohibited from using your images for any other purpose. Seekee does not share any biometric face data, because Seekee does not collect or extract biometric face data.

We provide the following disclosures regarding images that may contain people and any related biometric information:

- Seekee does not collect biometric face data. - Seekee does not perform facial recognition. - Seekee does not extract facial templates, facial landmarks, or facial embeddings. - If you upload an image that contains people, we process the entire image only as an ordinary image. - Faces are not separately identified, analyzed, or stored. - Images are used solely to perform the AI features you request.

We'll only keep your information as long as needed for our services and other legitimate purposes, like dispute resolution, safety and security, or compliance. The retention criteria in this section do not authorize using uploaded images for purposes beyond those set out in Sections 5, 6 and 7. When determining how long to keep your information, we may take the following factors into account:

- whether it's necessary to retain the information to provide Services; - how sensitive the information is; - potential risk of harm from unauthorized use or disclosure; - any legal requirements that we are subject to.

We are based in the United States. Depending on your location, the features you use and the service arrangements of the relevant providers, the personal information we collect may be transferred outside your country or region and stored or processed there, including by staff working for us or our service providers. Data protection laws may differ between jurisdictions. By using Seekee Services, you consent to your personal data being transferred outside of the country where you live.

We will provide applicable notices about the actual processing locations and cross-border arrangements and adopt the necessary transfer mechanisms and safeguards in accordance with relevant laws. For transfers restricted by European Economic Area or United Kingdom law, we will proceed only where a valid legal mechanism and the required safeguards are in place. You may contact us through the channels listed in this Policy to learn about these arrangements and request information about the safeguards in accordance with applicable law.

We implement appropriate technical and organizational security measures to protect your personal information. All files stored on Seekee are encrypted both in transit and at rest using industry-standard encryption protocols.

No method of transmission over the internet or method of electronic storage is 100% secure. While we use reasonable efforts to protect your information, we cannot guarantee its absolute security.

You can access, update or change the information from the account you created. When changing or updating the information you provided, it may be required to verify your identity first. Please note that we may be required by law to store the information we collect, even after you have terminated your use of Seekee Services.

For technical reasons, it may be impossible for us to determine whether you have stopped using the Seekee Services. For mobile applications, it may also be impossible for Seekee to determine whether you have deleted the application. In such cases, we reserve the right to remove your account and the information you have provided to us if you have not used the Services for an extended period of time.

10.1 United States Residents

When relevant state privacy laws apply to our processing, you have the rights provided by those laws, including rights to information, access, correction, deletion, portability and applicable opt-outs. Their specific applicability depends on the conditions set out in the relevant laws.

Where disclosure is required by law, we will provide information consistent with our actual processing concerning our information practices over the preceding twelve months, as well as sale, sharing, sensitive information and categories of recipients. The general statements in this Policy do not exclude applicable requirements concerning consent for minors, limitations on sensitive information or opt-out mechanisms.

If applicable state law gives you a right to an internal appeal, you may appeal our decision on your request by contacting contact@seekeeverge.com and indicating “Privacy Request Appeal”. We will respond as required by applicable law and inform you of avenues for further redress.

10.2 European Economic Area and United Kingdom Residents

When relevant data protection laws apply, we act as a data controller to the extent that we determine the purposes and means of processing. You may exercise the rights described in Section 9 of this Policy in accordance with applicable law and lodge a complaint with the data protection supervisory authority in your location or another competent authority.

For processing based on legitimate interests, you may object on grounds relating to your particular situation in accordance with applicable law. For direct marketing, you may object to the relevant processing at any time in accordance with applicable law. Where automated decision-making meets the conditions specified by law, you have the safeguards and remedies provided by applicable law.

Where the GDPR applies, we generally respond to rights requests within one month of receipt. If the conditions for an extension are met, we will notify you within the prescribed period. Where a representative or data protection officer must be appointed by law, their contact details will be provided in the relevant regional notices.

We do not knowingly collect any information from children, as defined by applicable law, unless we have parental consent or applicable law otherwise permits such collection. If we learn that we have inadvertently collected the information of a child, we will take immediate steps to comply with applicable privacy laws, which may include deleting that information.

Personal information of children and adolescents is subject to special protection. The age requirements applicable to the Services should be determined in light of the specific service and the laws of the relevant location. General consent under this Privacy Policy does not replace parental or guardian consent required by law.

Where the United States Children’s Online Privacy Protection Act applies, we will not collect, use or disclose personal information of children under thirteen without fulfilling the statutory notice, verifiable parental consent and other necessary requirements. Where other jurisdictions or United States state laws impose additional requirements for minors of a higher age, we will comply with the applicable requirements.

If we learn that we have processed children’s personal information without the necessary legal basis or authorization, we will take steps required by law, such as deleting the information, stopping the relevant processing or taking other necessary measures. Parents or guardians with questions or requests concerning the processing of children’s information may contact us at contact@seekeeverge.com.

Our Privacy Policy applies to all of the services offered by Seekee. Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that you may interact with or see through the browser, or other sites linked from our services. Please refer to those third party privacy policies for details about their information practices.

This Privacy Policy will be periodically revised and may be changed with or without notice. The updated Privacy Policy will be posted on the Seekee website at https://www.seekeeverge.com/privacy. By using or continuing to use the Services you agree to review the Privacy Policy periodically so that you are aware of any modifications. If you do not agree to the Terms of Use or this Privacy Policy, you should not use any of the Seekee Services.
